The General Terms and Conditions which follow describe the conditions under which Chateau.com, hereafter called “Chateau” or “we”, provides access to its services.

These General Terms and Conditions define the conditions for your use of our services on the www.Chateau.com website.
By clicking on the “I agree” button, you confirm that you agree with all the stipulations of these General Terms and Conditions. If you do not accept these General Terms and Conditions, you will not be able to use our services.
Once your registration on www.Chateau.com is accepted, you pledge to comply with these general terms and conditions in full.

Conditions for registration

Our services are reserved exclusively for people who may legally enter into contracts under French law. Pursuant to French law No.59-107 dated 7 January 1959, the sale of alcohol is prohibited to minors under the age of 18.
The purchaser therefore warrants that they are more than 18 years old on the order date.
Article L. 3342-1 of the French Code of Public Health prohibits “in public bars and all retail outlets or public places, the sale or the supply free of charge to minors under the age of 18 of alcoholic beverages for consumption on the premises or elsewhere”.
When you register, you acknowledge that you have understood the general terms and conditions, that you are an adult according to current legislation, that the laws of your country authorise you to purchase and ship your wines and use the means necessary to prevent access to this site by minors.
If you do not meet these conditions, you must not use our services.
The abuse of alcohol is dangerous for health. Consume in moderation.
You agree to respect the laws, regulations or standards of any kind in force in France and in any country where deliveries may be made, relating to the purchase of products containing alcohol.

The laws in force in your home country are different from those in force in other countries in numerous respects, and also with regard to beverages containing alcohol which can be legally sold and exported/imported.

Registration on Chateau.com requires your full acceptance of the general terms and conditions. Once your registration on Chateau.com is confirmed, you can make purchases and access your area on our site.
In order for us to validate your registration, you must provide your surname, first name, address and email address.



Invoicing

Prices can be shown in various currencies (US Dollars, Rouble, Yen, Pound sterling or Euros) but, except where otherwise stated, our final charges will only be payable in Euros.
Our prices are non-binding and subject to available stock. Valid prices are those given at the time of the order as shown on our site (errors and omissions excepted).
Our site is updated automatically after each sale.
Payment is due at receipt of invoice, unless agreement and without discount. Late penalties rate ,which are payable starting from the day after the payment date, is equal to the interest rate applied by the ECB to its most recent refinancing operator plus 10 %. For any professional or public buyer in arrears debtor, a fixed compensation of 40 euros is due for recovery costs.

Quality guarantee

Chateau.com accepts responsibility for the accurate description of the products shown on its site (product authenticity and condition).
The photographs displayed online correspond to the bottle that you will receive.
When making multiple purchases, the other bottles bought will be in the same or better condition as the one visible on the site.
Chateau shall not be held responsible for comments, criticisms and descriptions in the description of the wines.

Chateau.com retains ownership of the merchandise until payment is received in full, in accordance with French law no.80-336 dated 1 May 1980, on the retention of title. No reservation will be accepted.

On receipt of your payment, Chateau.com will forward an invoice to the email address linked with your account.

Delivery and collection of purchases

A- Delivery / Shipping:
Chateau.com is committed to ensuring your products are delivered under the best conditions. The bottles are packaged in suitable packing materials and insured for a stated sum against the risk of damage during transport.(See our price list)
From Monday to Friday, your order is shipped within 24-48 hours of receipt of payment.
The order will be shipped to the address provided by the purchaser during order confirmation.
Check that the details provided during confirmation are accurate. Please ensure that somebody is present during delivery, and if possible provide a telephone number.
Delivery in mainland France takes between 2 and 5 days depending on destination. For deliveries abroad, the time taken will vary according to the destination.

B- Transport problems:
In the event of a problem on receipt of your parcels, you must check the contents of the parcel(s), before you sign for delivery.

Any discrepancy must be stated on the delivery documentation, with an accurate description and the quantity of damaged or missing wines. You must then inform the carrier by registered letter within 3 days of receipt.
You must also contact us in order to initiate the compensation procedure by forwarding the transport documentation to us.

Unless otherwise indicated, neither Chateau.com nor the carrier shall be held liable.

Returning bottles

In application of the measures of the article L.121-16 of the Consumption code, you can use your right to withdraw to return us the article(s) without having to prove any motive.
You have a deadline to return a product of seven (7) days according to the date you received the concerned product, which is confirmed by the postmark or the signature of the delivery.
The expenses of returns and insurance (covering necessarily the complete amount of the sent back product) are at your expense.
In case of an overtaking of the retraction period, no return is acceptable. The possible expenses which you could have invested would be lost.

Amount refund: Chateau refunds the amount of the products invoiced. Attention, the shipment cost due to the routing of the parcel will not be refund.
IMPORTANT
Even if we take the biggest care of the preservation of wines that we sell (temperature, hygrometry, sleeping around and darkness), we cannot agree to replace a product for the following motives:
-Inappropriate taste: we cannot exchange bottles, opened or not, having a taste which you could consider inappropriate in your tasting (caressed, oxidized bottles, in decline or other one.).
-Label, ruffle or capsule which are damaged, dented, old-looking: bottles in particular from old vintages can sometimes have undergone outside damages not impacting on the quality of their contents.
A photography of every product proposed in a not standard state is available on a simple request. It is your responsibility to ask for it at the following address: contact@chateau.com, before any purchase of a product. Photos of products published on the website have no contractual character.

Storage facility

Our storage facility guarantees the best conditions for storage: appropriate, constant humidity and temperature.
We can also store your wines on request.
Once 30 days have elapsed from the date of purchase, you will be charged for storage at the rate of €1.50 per bottle/week. Collection from our cellars is by appointment only with our storage service.

Access to the site and damage to the integrity of the site

You agree not to use software or manual processes to copy our internet pages or to record or collect the information on these pages without our prior express agreement in writing. You agree not to use devices or software of any kind to disrupt or attempt to disrupt the effective operation of our site. You agree not to undertake any action which would impose a disproportionate load on our infrastructure. Most information contained on our site is updated in real time. You agree not to copy, reproduce, alter, modify, create works derived from or share all or part of the contents of our site with the general public without express agreement in writing by us or the third parties concerned.

Applicable law; Litigation

The present General Terms and Conditions are governed and interpreted according to French law. French courts shall have jurisdiction in all disputes which may arise between the parties relating to the execution of these general terms and conditions.

Site services and confidentiality

A. Exception, force majeure:
- We do not guarantee that our services will be uninterrupted, free from any error or reliable.
- We reserve the right to limit our site activity from time to time or on a permanent basis, without prior notice.
- We may not be held liable for any failure to respect our obligations under the present General Terms and Conditions caused by events beyond our control and/or resulting from a case of force majeure.
Cases of force majeure include in particular, in addition to those cases recognised by law, any natural disasters, acts of war, attacks on public order, epidemics, fires, floods and other disasters, any government action, strikes, lock outs, as well as all electric and technical problems outside the parties’ control and which prevent communication.

B. Confidentiality
Chateau agrees to respect the confidentiality of information provided by the purchaser, such information being exclusively for Château’s purposes.

Under the terms of Article 27 of French law No. 78-17 dated 6 January 1978, purchasers are free to amend or withdraw information pertaining to them. We can use your data (e-mail, postal addresses and telephone number) to send you information which is targeted according to your interests, or information relating to the provision of new services, promotions, or your use of the site. By accepting the General Terms and Conditions for use of our services, you expressly agree to receive such information.

- The present General Terms and Conditions, along with documents incorporated by reference, form the entirety of the agreement between the parties.
